The first of the transvaginal mesh lawsuits to reach a jury verdict was filed by Christine Scott, of Bakersfield, California. Scott was treated by a surgeon for urinary incontinence with a transvaginal mesh made by C.R. Bard, a medical device manufacturer. After surgery, Scott suffered from erosion of the transvaginal mesh into her colon, fecal incontinence, and inability to have sexual intercourse. The jury was presented with evidence that the manufacturer did not test their mesh properly before putting it on the market. The jury found that, indeed, C.R. Bard was negligent in selling a defective product and awarded $5 million dollars to Scott and $500,000 to Scott’s husband for loss of consortium with his wife. The jury further found that C.R. Bard was responsible for 60% of the award and the treating surgeon was responsible for 40% of the damages. The verdict in Christine Scott’s case is an important step in recognizing the potential harm that can be caused by transvaginal mesh surgery to thousands of women worldwide and the willingness of a jury to hold the manufacturers and surgeons responsible.
